By commissioning, purchasing, or otherwise obtaining artwork from OccultOtter, you (“the Client”) agree to the following Terms of Service. Please read these terms carefully before proceeding with any transaction.1. Ownership & Copyright
All artwork created by OccultOtter is the intellectual property of the artist, unless explicitly agreed upon in writing.
The artist retains full rights to the artwork, including but not limited to displaying it in portfolios, galleries, social media, and other promotional materials.
The Client receives a license for personal, non-commercial use only, unless a separate commercial agreement is made.
2. Usage Rights
The Client may:
Use the commissioned artwork for personal use, such as profile pictures, wallpapers, personal prints, or social media posts with proper credit.
Share the artwork online with visible and clear credit to the artist (e.g., “Art by OccultOtter” with a link or tag when possible).
The Client may not:
Use the artwork for commercial purposes (e.g., merchandise, advertisements, NFTs, book covers, promotional material, etc.) without explicit written permission and the payment of an agreed-upon commercial fee.
Alter, edit, or modify the artwork significantly without prior permission.
Remove or obscure the artist’s signature or watermark.
Claim the artwork as their own or fail to provide proper credit when sharing the artwork publicly.
3. Commercial Use
Commercial use must be discussed in advance and will incur an additional fee.
Commercial licensing terms will be provided in writing, tailored to the scope of usage (e.g., one-time license, exclusive rights, resale rights, etc.).
Unauthorized commercial use will be treated as a breach of contract and may lead to legal action or additional charges.
4. Payment & Refunds
Full payment is required upfront before work begins. Specific payment terms will be communicated on a per-project basis.
Refunds are not available once work has begun. In cases where the artist is unable to complete the artwork, a partial or full refund may be issued at the artist’s discretion.
5. Revisions & Approval
The artist will provide opportunities for revisions at specified stages (e.g., sketch, line art). The number of included revisions will be agreed upon before starting the project.
Excessive revisions or changes after final approval may result in additional charges.
6. Turnaround Time
The expected turnaround time will vary depending on the complexity of the artwork and the artist’s schedule.
Estimated delivery times will be communicated clearly, but deadlines are not guaranteed unless explicitly agreed upon in writing.
7. Confidentiality & Privacy
The artist respects the privacy of the Client. Any personal information shared will be kept confidential and not shared with third parties.
If the Client prefers the artwork to remain private or unpublished by the artist, this must be requested in writing before the commission is started.
8. Final Files & Delivery
Final artwork will be delivered in digital format unless otherwise agreed upon.
High-resolution images will be provided in commonly used file formats (e.g., PNG, JPG, PDF).
Physical prints or items are not included unless specifically arranged.
9. Rights to Decline or Cancel
The artist reserves the right to decline or cancel a project for any reason, including but not limited to inappropriate content, harassment, or unreasonable demands.
If a project is canceled before any work has begun, a refund will be issued in full.
10. Acceptance of Terms
By commissioning or purchasing artwork from OccultOtter, you acknowledge that you have read, understood, and agreed to these Terms of Service. If you do not agree to these terms, you may not use or commission the artist’s work.
